These terms govern use of the DiscFunktional website, accounts, tools, public sharing features, forms, and purchases. Please read them before creating an account or placing an order.
Acceptance and eligibility
By using the site, creating an account, making a submission, or placing an order, you agree to these Terms and the policies linked from them. If you do not agree, do not use the affected feature. Accounts and forms are intended for people age 13 or older. If you are under the age of legal majority, use the site with a parent or guardian. Purchases must be made by an adult or with an adult’s authorization.
Accounts and security
Provide accurate information, keep credentials confidential, and promptly update account details. You are responsible for activity under your account unless applicable law provides otherwise. Do not share another person’s private information or use an account to impersonate, mislead, interfere with the service, or evade a restriction. Contact DiscFunktional if you believe an account has been accessed without permission.
Your submissions and public content
You keep ownership of content you submit, including reviews, photos, bag data, course reports, feedback, applications, support messages, and profile information. For content you keep private, you grant DiscFunktional only the limited, nonexclusive license needed to host, store, format, process, secure, and support the requested account, submission, or feature. Private content is not licensed for public display or promotion.
When you choose public or unlisted visibility, submit a review or report intended for display, or separately authorize publication, that limited license also permits DiscFunktional to reproduce, format, display, moderate, and promote that public submission and the related feature. These licenses end when the content is deleted, made private, or the authorization is withdrawn, subject to reasonable technical, backup, legal, moderation, and already-shared copies.
You represent that you have the rights and permissions needed for submitted content. Do not submit unlawful, infringing, deceptive, threatening, hateful, harassing, sexually explicit, privacy-invasive, malicious, or technically harmful material. Do not include another person’s private contact, location, payment, or account information without permission. DiscFunktional may refuse, remove, limit, or preserve content where reasonably needed to enforce these Terms, protect people or systems, respond to a complaint, or comply with law. Ordinary negative feedback will not be removed merely because it is negative.
Products, prices, and orders
- Product images, colors, sizes, materials, specifications, availability, and prices can change. Screen colors and print placement may vary within reasonable production tolerances.
- An order confirmation acknowledges receipt; it does not require acceptance of an order that cannot be fulfilled, contains an obvious pricing or listing error, fails payment or fraud review, or violates these Terms.
- Mandatory charges are shown before payment. Shipping is shown separately where permitted, and taxes are handled according to the checkout configuration and applicable law.
- Some products are made, printed, or packed after ordering. Review the live product options, size information, and delivery estimate before payment.
- If an item becomes unavailable, DiscFunktional may offer a clearly described substitute, request consent to a delay, or cancel and refund the affected amount as required by law. A substitute is never forced without the return and refund rights required by law.
The Shipping, Returns & Refunds Policy is part of these Terms. Nothing in these Terms limits nonwaivable consumer warranty, refund, chargeback, or other statutory rights.
Course guides, recommendations, and practice content
Bag Builder, Disc Finder, Course Ready scores, product suggestions, practice plans, weather-based estimates, course guides, and other content are informational planning tools. They are not guarantees of performance, availability, safety, compatibility, course access, or official conditions. Manufacturer specifications, park rules, fees, closures, hazards, weather, and course conditions can change. Verify important information with the manufacturer, course, park, event, or other official source before relying on it.
Practice content is not medical or professional coaching advice. Use equipment appropriate for your ability and conditions, warm up, choose a safe area, follow local rules, and stop if you experience pain, dizziness, unsafe weather, or another concern. See the Course & Tools Disclaimer.
Reviews, endorsements, and relationships
Reviews must reflect a real, honest experience. If DiscFunktional offers a review incentive, the offer will be shown beside the review request, will never depend on positive sentiment, and a review receiving the benefit should display that relationship. No incentive is active merely because this policy describes how one would be handled. Creators, team members, event partners, employees, family members, or others with a material connection must disclose it clearly. DiscFunktional may moderate reviews consistently for spam, privacy, abuse, irrelevant material, conflicts, or demonstrably false content, but will not suppress an otherwise valid review because it is critical. Acceptable use
Do not probe or bypass security, scrape at a rate that disrupts service, introduce malware, misuse APIs, automate fake activity, manipulate reviews or leaderboards, access another user’s private data, violate intellectual-property or privacy rights, or use the site for unlawful activity. Reasonable personal use, ordinary sharing, accessibility technology, and search-engine access that follows published controls are permitted.
DiscFunktional content and intellectual property
Except for user content and third-party material, the DiscFunktional name, logos, artwork, product designs, site copy, software, and original page designs are owned by or licensed to DiscFunktional and may not be copied for resale, impersonation, or commercial use without permission. Linking to public pages and sharing built-in public links is welcome. For a copyright, trademark, privacy, or content concern, use the Contact page with the URL, the work or right involved, and enough information to evaluate the request. This is a general complaint channel and does not claim a registered DMCA agent unless one is separately identified.
Third-party services and links
Payments, fulfillment, shipping, email, analytics, video embeds, maps, and external links may be provided by third parties with separate terms and privacy practices. Eligibility for wallets or pay-later services is determined by the provider. A link or embed does not mean DiscFunktional controls or endorses every statement, product, or practice on the destination.
Availability, warranties, and limits
The site and free tools are provided on an “as available” basis. DiscFunktional works to keep them useful and accurate but does not promise uninterrupted access, error-free calculations, a particular score or result, or that every third-party source is current. To the maximum extent permitted by law, DiscFunktional is not responsible for indirect, incidental, special, or consequential losses arising from use of free informational tools, external sources, or user-submitted content. Nothing here excludes an express product promise, responsibility for DiscFunktional’s own wrongful conduct, or any warranty, liability, remedy, or consumer right that cannot legally be excluded or limited.
Suspension, changes, and contact
DiscFunktional may restrict an account or feature where reasonably necessary for security, abuse prevention, legal compliance, or repeated violation of these Terms. When practical, we will explain the action and provide a way to contact us. Material Terms changes will be posted with a new effective date; continued use after the effective date accepts the revised Terms only to the extent permitted by law.
